At Breathfree3, we want you to feel confident when you subscribe to our platform. This Policy explains your rights to cancel your subscription, how to do so, and when you are entitled to a refund.

This Policy does not constitute professional legal advice. We recommend seeking independent legal counsel for your specific situation.

1. Your Right to Cancel

You may cancel your Breathfree3 subscription at any time. Cancellation instructions are set out in Section 3 below.

When you cancel, your subscription will remain active until the end of your current billing period. After that date, your account will be downgraded or closed and you will not be charged again.

2. Cooling-Off Right (14-Day Withdrawal Right for Consumers)

If you are a consumer within the meaning of Dutch and EU law (meaning you are subscribing as an individual acting outside a trade, business, or profession), you have a statutory right to withdraw from your subscription contract within 14 calendar days of the date your subscription starts, without giving a reason.

This right is granted under Article 6:230o of the Dutch Civil Code and EU Directive 2011/83/EU on consumer rights.

3. How to Cancel Your Subscription

You can cancel your subscription at any time in one of the following ways:

We will send you a confirmation email once your cancellation has been processed. Please keep this for your records. If you do not receive a confirmation within 2 business days, please contact us again to ensure your cancellation was received.

We reserve the right to decline a refund request if we reasonably determine that the request is fraudulent, abusive, or in breach of these Terms.

5. Exceptional Refunds

Outside the statutory cooling-off period, we may, at our sole discretion, consider a goodwill refund or account credit in exceptional circumstances, including:

6. How Refunds Are Processed

Approved refunds will be returned to the original payment method used at the time of purchase. Processing times may vary depending on your bank or payment provider but typically take 5–10 business days to appear in your account. We will not issue refunds to a different payment method than the one used for purchase.

7. Disputes

If you believe you have been charged incorrectly or have a billing dispute, please contact us at support@breathfree3.rolandb31.com before initiating a chargeback with your bank or payment provider. We are committed to resolving issues fairly and promptly.

If a dispute cannot be resolved directly, you may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, or contact the Dutch consumer authority (Autoriteit Consument & Markt) at www.acm.nl.

8. Governing Law

This Policy is governed by Dutch law. If you are a consumer in another EU member state, you also benefit from the mandatory consumer protection laws of your country of residence.
